    Transportation of personal belongings abroad: how to get a permit for shipping cultural goods

    When transporting personal effects abroad our clients should be aware that some items (awards, coins, icons, stamps, art works, sculptures etc.) might be classified as “cultural values (cultural property)” or “antiques”.

    According to the current legislation “antiques” includes objects older than 50 years. Cultural values (cultural property) are objects of material and spiritual culture that have artistic, historical, ethnographic and scientific significance and are subject to preservation, recreation and protection in accordance with the legislation of Ukraine.

    That’s why to avoid difficulties during customs control, it is necessary to obtain in advance from the Department for the movement of cultural property (hereinafter – the Control Body) the certificate confirming that the object is not a “cultural property”.

    In case you have an object that is a cultural property you will have to receive certificate which gives the right to transport cultural property abroad.

    The Law of Ukraine “On the export, import and return of cultural property” states the rules on the export, import and return of cultural property. A certificate for the right to export (temporary export) of cultural property is obligatory for shipping the cultural property outside the customs territory of Ukraine. Cultural values (works of art, old books, coins, stamps, awards), entered in the State Register of National Cultural Property, in the National Archives or the Museum Fund of Ukraine are prohibited for export abroad. Attempted transportation is a criminal offence.

    Where to get a permit for transportation of cultural values

    According to the latest information, regarding the procedure for issuing a certificate and conducting an examination of cultural property for export from the territory of Ukraine, you can contact the Control Authority:

    • State Service for Control over the Movement of Cultural Property across the State Border of Ukraine under the Ministry of Culture and Arts of Ukraine: 01015, Kyiv, st. Lavrskaya, 9, building 20.
    • Departments of Culture of the executive body of specific regions are located in the following cities:
    • Kyiv (for Zhytomyr, Kyiv, Luhansk, Sumy, Kharkiv, Cherkasy, Chernihiv regions, Kyiv city)
    • Dnipro ( for Dnipropetrovsk, Donetsk, Kirovohrad, Poltava regions);
    • Lviv ( for Volyn, Lviv, Rivne, Ternopil regions);
    • Odessa (for Vinnytsia, Zaporizhia, Odessa regions);
    • Uzhgorod (for Zakarpattia region);
    • Kherson (for Kherson, Mykolaiv regions);
    • Chernivtsi (for Ivano-Frankivsk, Khmelnytsky, Chernivtsi regions).

    The procedure for obtaining a certificate

    An application for the right to ship personal effects that may include cultural property is submitted to the Control Body no later than one month before the planned date of crossing the border. Shipper must attach to the application the following:

    • for an individual –passport/ id card;
    • for a legal entity – EDRPOU code;
    • a document confirming the rights of the owner;
    • two copies of the list of cultural values ​​that are planned to be shipped (indicating all information about authorship, title of the work, place and time of creation, material and technique of performance, dimensions (weight), insurance value (cost, estimated value));
    • the corresponding customs declaration, which was submitted to the customs authority when importing cultural property to Ukraine;
    • two copies of color photographs, except for numismatics, philately, phalerology and bonistics;
    • the conclusion of the state examination;
    • other documents (for instance passport of musical instrument)

    The final decision on the granting of the right to export (or its prohibition) cultural property ​​is taken by the State Control Body (or its representative). At the same time, on the certificate, as well as on each page of the list of cultural values ​​and their photographs, the official of the State Body must put the stamp “Permitted for export from Ukraine”. In addition, the certificate number and the date of its issuance must be indicated in the list and on each photo. One set, including a list of cultural values ​​and all photos, remains in the State Control Body, and the second is given to the owner.

    The certificate, which gives the right to transport such items abroad, is valid only for 6 months.
